Obscure, generic and ambiguous fair use policies FTW!

you're also free to try to download the entire internet every month if you want.

just be prepared to pay the consequences and costs of doing both.

in the latter case, it means that if you're downloading more data than the average user, be prepared to pay higher than average prices.
then i guess the only problem people would have is if they are paying for what is suppose to be an unlimited service and then getting booted out for downloading above what is considered by the ISP as beyond the fair use policy. why even offer an unlimited service if you are going to boot out people for downloading the internet then?

Nah the accc only cracked down on companies with names that started with TELSTRA and OPTUS

Honestly, just contact the ombudsman and complain. That will set them straight.

Here you go: The TIO

Agreed. They seemed to justify it by saying the connection still continued but it was restricted in speed only. Therefore still unlimited. Pfft.

IMO.. unlimited = whatever the amount of data you can pull per month, based on your maximum upload and download speed. Anything more is...

A) Impossible
B) Breaking the laws of physics
C) Your ISP is lying to you, or spoofing extra data

And that's where they got you, the speed varied ; )

Many times it was so slow it was barely usable even for just basic browsing.

they're paying for a service with no fixed download limit, but governed by an AUP.

that said, I agree that Spintel are being very brave using the long-demonised "U" word since the ACMA cracked down on it.

because I don't think it's unreasonable to expect customers to use their service in a reasonable way, and flogging it 24/7 comes under my definition of abuse.

unfortunately, enough people don't seem to have a basic understanding of what "reasonable" means or entails, thus leading to bleating to the ACMA, and leading to where we are now.

I'm with TPG, and My usage was 400GB average from october to march. Last 3 months have been 3TB each. GL to them if they try and suspend my plan, its unlimited, not, 'sorta unlimited'

If your going to promote your service as unlimited, it needs to operate that way i.e. with no limits. To do otherwise is simply baiting your customers.

if someone thinks they are getting a service where they can flog it 24/7 at max line speed for $40 a month compared to the rest of the industry, who's the fool?

if its not viable for the ISP to charge $40 for truly unlimited (meaning no throttling, no capping) and not sorta unlimited. then they should charge more.

The ISP, for offering a service at a greatly underpriced amount!
