ie: when the fan goes to full speed it just instant turn off
have pulled it apart its a heatsink with heatpipes to the side then a fan

Well 1st of all you've probably just voided the rest of your warranty by opening the unit up Hopefully you didn't break any stickers in doing so, and can put it back together so they'll never know...

The sticky thermal pads are usually pretty bad. AS5 it and put it all back together and see if it makes any diff. But if warranty claim is an option don't do this.

What BIOS options do you have re processor? Do you have any Windoze power management options that slows down the CPU (like I do on my Toshiba lappy)? Try getting a program that can show the temp of the CPU (long shot, try speedfan or MBM or something)

Off the top of my head, try seeing if the same happens when the fan is unplugged... obviously you wouldn't do this for long - certainly turn it off immediately if the heatsink gets too hot to the touch- but perhaps the fan is shorting or something?

But warranty claim is your best bet, if it still is under warranty. Let them deal with it, you just care about getting a working one.

They add a gap and have fans in the base that blow cool air onto the laptop as far as I know. Replaceing the thermal pad with AS5 will help too, I know it did on my presscot-powered acer.

Have you cleared the heatsink of dust with an air compressor? Same goes with replacing/removing any crappy thermal paste on there.

Agreed. I spent $65.00 on a Zalman(ZM-NC1000) aluminium twin fan with extra USB port and fan speed control.

Until I got this, my notebook was shutting down or crashing to desktop when I was gaming with it. Has never happenned again since using the notebook cooler.

You can get these from Ebay. Careful, some of the cheap ones are a bit dodgy.
