I just decided to go back there and have another try - still no refund, but I got the manager to go from rude to downright abusive after I pulled out a printed copy of the Trade Practices Act and started pointing to relevant sections. It would seem that no matter what they say about 7 days DOA or whatever, a person's rights to refund still stand - and in this case, this is reasonably and obviously "unfit for purpose".

I'm going to try another MSY store tomorrow - Plympton - and see if they are more reasonable... I might bring my entire rig in too. Then it's written complaint time.
Damn you and your sneakiness!! *shakes fist* Hi gm!

Well, I'm going with the owner of the system not tomorrow but next saturday early in the morning (as thats the only time he is free, and I thought I better bring him along since it's his name on the receipt). I plan to rock up with the entire system (all purchased from them), plug it in and demo it right in front of the tech. They aren't taking my money to test, ill do it for free! Plus, the guy i spoke to on the phone admitted that they don't have any i7 test rigs, so I'm doing him a favour

May be you should have read MSY's terms and conditions? It clearly states 7 days RMA exchange or 15% restocking fee, every store has this clearly plastered on the walls. U bought it 3 months ago, if you did not have the time to debug then its your problem.. bl

People in the computer retail industry have to serve douchebags all day, do you think u're doing urself any favours trying to bug them more?

Go direct ur rage @ gigabyte for making a fucked card and not addressing it...

(your friendly ex-computer retail salesperson)

Well like a few others in this thread, I went ahead and ordered an EVGA GTX 275. Too my surprise, its the regular povo edition but clock speeds are the SC.

Was going to run with tri-sli, but impossible with my current case. There is only space for a single slot PCI-e card left.

The EVGA works 100% as I'm typing this post now. Good bye Gigabyte, RMA you go.

Go read the trade practices act - it says that no contract between the trader and customer can override the legal rights of the customer.

Hey guys.
I have been experiencing a similar problem, but its never really bothered me until.. well...

I just bought 2 Samsung 2233SW+'s and when trying to use them together they do. not. work.
Windows wont let me change the setting to "extend monitor to this display", when I open nvidia control panel sometimes they both turn off and i have to pull the plug and replug them back in, or more regularly the picture switches from 1 monitor the other every few seconds.

Is this likely a problem caused by the fault you guys are experiencing?

Yes, it could very well be screen detection or drop outs, but it should if its caused by the same issue be intermittently detectable, if your second screen is not detectable at all then it may be another problem.
Im shocked that theres such a wide spread problem with the cards, I have sold a few >>
Never heard about a problem from those ive sold some GTX260 models to, maybe they were lucky or something, dunno.
I hope RMA'ing these cards fixes the issue.

Partha, you may be spot on about suggesting others avoid getting the cards for the time being, but be careful, vendor verdicts are against forum rules for a reason.

I'll put up a poll if i can on the OP, to see who gets problems and the number of screens users were/are using. Cant add poll, might try and ask a mod to. Off to uni now so i'll get something up later.

I actually found a newer ref bios from XFX .03 as opposed .01 on my gigabyte. So I flashed it and it wroked but made the issue even worse.

Basically gigabyte has royally screwed up here and lost any of my future business.
They have in a way. The Gigabytes UltraDruable's uses a different PCB design than the nVidia reference that eVGA or XFX use(actually noy 100% sure if they use reference, im just basing this on them being board partners with NV). The BIOS's might not be 100% compatible. IF there was indeed a BIOS fix available, it make take some time as GB are royally slow at rolling out VGA updates.

The Gigabyte 9800GTX+ 1GB issue where drivers above 17x.xx did not work at all, the BIOS fix didn't come for months(eventually did).

Once im home today, i'll check my BIOS on my card. My current replacement Gigabtye is going well, right now maybe 1 in 50 chance of no POST on warm boot and in 3 weeks, only once did it let my primary monitor go to sleep/standby.

zha50, I will get in touch with William Kao and let him know how widespread the issue is and see if they are working on a fix bios and weather they can supply one.

Could I get a post of all the card models (and revision if printed) confirmed with the defect?

I dont have my hands on one of these models atm, and Ive sold a few of the 260's that dont seem to have the issue, but will keep an eye on this thread and hope everyone affected get their card issues resolved.

hi william, i'm just round the corner from clayton - upwey. as mentioned in my earlier post i get occasional issues with my card. to be specific they come on a cold boot as well as black outs and driver fails when using nvidia control panel. unlike others my problems are more occasional than the norm. i would say that i've had 5 or 6 instances that these faults have happened in the last 3 weeks with a re-boot resolving the problem.

bearing that in mind i have to admit my disappointment... i chose gigabyte and paid the extra coin because i wanted a name brand i could trust. having used gigabyte products before with no issues; spending a few hundred bucks on something that does not work perfectly is not what i would expect.

if you can provide a replacement whilst your looking at my card i'd happily swap it out for you to do some testing. its obvious that there is something wrong and if in any way i can help the cause - i'm in.

i'll pm you with my details and look forward to your response.
