Looks like Apple have been caught with there pants down again, they have been caught doing the same with the phone lawsuit.

Apple has provided flawed visual evidence of similarities between the iPhone 3G and Samsung's Galaxy S smartphones to the District Court in The Hague, an investigation by Webwereld.nl, a Dutch IDG publication, has found.

This time, a picture of a Galaxy S smartphone has been resized to match an iPhone 3G.

Size Misrepresented

On page 77 of the complaint, seen by Webwereld, Apple's lawyers have provided a picture of an iPhone 3G next to a Samsung Galaxy S as "an example of the similarity relevant to copyrights."

But the picture Apple submitted of the Galaxy S is inaccurate and does not match the real Galaxy S. Further analysis has confirmed this assessment. The Galaxy S, introduced in The Netherlands in July 2010, is both taller and wider than the iPhone 3G.

apple samsung patent legal caseAccording to Samsung, the dimensions of the Galaxy S are 122.4 by 64.2 millimeters. The iPhone 3G measures 115.5 by 62.1 millimeters. In the text, Apple confirms that the Galaxy S has "some non-identical elements, such as the slightly larger dimensions."

But the picture of purported Galaxy S has been resized about 6 percent, making the Galaxy S appear smaller and more similar to Apple's phone. The height of the purported Galaxy S that Apple displays matches the iPhone exactly. The aspect ratio has not been measurably altered.

Apple also provided an unknown number of other pictures of Samsung's smartphones and tablets side-by-side with its own in separate productions, which were not available for inspection. There's only one picture of an iPhone side-by-side with a purported Galaxy S in the complaint itself.

A legal expert on intellectual property cases, who declined to be named, asserted that when pictures are filed both in the complaint and in separate productions, those in the complaint would be considered more important. Visual evidence presented there typically indicates that the plaintiff wants to emphasize its significance, he said.

Apple's filing requests injunctive relief across Samsung's entire line of Galaxy products including the Galaxy Ace, S, and S II, the Galaxy Tab 7 and 10.1, and the Galaxy Gio, Nexus, 551, Europa, Apollo, and Mini. The Cupertino-based manufacturer also wants a much more comprehensive injunction than it won ten days ago. The initial injunction only covered product imports. Many resellers carried on business as usual, as phones that were already in-country or sitting on store shelves were fair to sell.

This time around, Apple wants that loophole closed. The company wants the new injunction to cover every step of the
process, including manufacturing, distribution, importing, exporting, and stocking. If granted, the ruling would freeze Samsung products altogether. The company further demands that Samsung recall all infringing products from its European clients within 14 days and cover the cost of distribution + original product purchase price. European companies that fail to return Samsung's products will themselves be held in violation of Apple's property rights.

I don't agree with that. I think Apple make a valuable contribution, the problem I see if that they seem to think everyone wants an over simplified product. Many do - many don't. I don't really see Android as competition to iOS as they really do cater to different markets.

iOS works for the people who "just want it to work". Android is more of an "I like to tweak" device.

Regardless, I hear the local court case between Samsung and Apple is next week, and my suppliers are quietly confident stock will be released.

If so, I'll seriously consider a group buy discount (ie - ~cost +PP) for anyone interested.

Kinda hard to explain that to just some people as they all think that its purpose is just competition. Possibly but there is more people out there that would prefer to just 'make it work'. Ive had many 'Android' based phones and Ive always had issues but it doesn't mean I'm going to stop buying a new phone with an Android OS on it. I only recommend 'Apple' products to people that just want the most simplified and stable software to work and not have to worry.

True, they do make good simplified products for simplified people, i have nothing against that, but to disrupt another company from selling their product based on "they took our dimensions patent" etc just screams "asshole" to me. To me the ethics of a company is worth more than the products that they produce.

Apparently a judge has ruled that they have only violated 1 patent out of the 10 patent's Apple were complaining about.
