GTX 970 lawsuit - what does this mean for Australians?

    A post on the Geforce forums

    "Just got off Chat with NewEgg and they are accepting returns on 970's. I have 2 and one that is even over the 30 days but no problem, RMA issued. The chat agent made it sound like they actually have a memo on it. They are not charging restock fees and also paying the shipping. They will do this for Store credit, which is fine by me. So they will be packed up and off to NewEgg tomorrow. Guess I'll wait to see what AMD has coming soon.

    I have all boxes and the cards have been registered via EVGA.

    I just message pccasegear about doing the same thing. Did a test, when loading at 4gb memory, which can be done in msi kombuster, it sits at 30 fps.

    Same test but load less memory, i get 80 fps (2gb memory).

    when initializing, once i reach the 3.5gb mark it slows RIGHT down, crashed once as well. It's definitely a problem.

    you can get a refund under australian consumer law in regards to the statutory guarantees.

    Ordered myself a 980, going to force my way for a return on the 970.

    Needed a bit more power anyway

    If the retailer sends the 970's back to the disty, I'd imagine they'd want you to stick to the same brand? Ie/ If you had Msi, the 980's would be msi?

    I'm thinking of the same, however, the equivalent 980 is still very expensive.

    I've 2xMSI 970 4GB "gaming" cards, -these were $500 ea - the 980 "gaming" costs $800 ea at pcCaseGear

    That means I'd have to fork out $600 (+ shipping I guess), which is a tad too much...:(

    But I use the card with 3 screens, so I can run into this trouble, I'm not sure but I think I actually already have (when windows complains about lack of resources, kicks you back to the desktop with a popup - the game slows right down after this, usually). Not sure.

    I only run one so I am upgrading that one. Will be perfect for me, won't need to add another for a long while!

    It's still a hefty expense for a little gain if you don't actually have a problem...it's 60% more expensive!

    Yeah I know, I do but, I'm sitting at 3600 memory used all the time. If I manage to go higher fps dips. Frustrating as hell.

    So which is the best 980 (in SLI)?

    Does not need to be an EVGA

    Maybe wait to return your 970 cards until you see a 380x/390x release and benchmark? :thumbup:
