as far as i can see the msi 3080 seems to be the one to go for as the chips on the back of 4 x large and 2 x small sets which is what is the same as reference

Yeah but if the fix may be to downclock which isn't covered by warranty, which means you may not be able to return the card as its been "fixed" lol
I'd only buy a card that is stable at the boost clocks...

boosts clocks are not guaranteed. only clocks guaranteed are base clocks.
Jayz2cents is talking about a firmware update, where the boost clock is lowered but the base clock stays the same.
They can do that since only base clock speeds are guaranteed. If they were to lower the baseclock via firmware, then you could return the card as then its not what you paid for.
You can not return a card because it wont hit boost clocks lol
